Mumbai Drug Bust Case Live Updates: “Aryan Khan Wasn’t Even On The Cruise, Nothing Found On Him,” Court Told

Mumbai sessions court is hearing the bail plea of Bollywood actor Shah Rukh Khan’s son Aryan Khan today. The Narcotics Control Bureau ​(NCB) has filed its reply, and the court is yet to come to a decision.

Aryan Khan’s lawyer Amit Desai has argued that Aryan didn’t have cash, so he couldn’t buy drugs, and since he didn’t buy drugs, he wasn’t going to consume any. In asking for bail, he has reiterated many times that no drugs were found on Aryan Khan, and of all the drugs seized, only six grams of charas was found with Arbaaz Merchant for his own consumption, not for sale.

Mr Desai has also argued that Aryan Khan wasn’t even on the cruise.

A Mumbai Magistrate court had on October 7 sent Aryan Khan and seven others to judicial custody for 14 days.

On October 8, the Esplanade court rejected the bail plea of Aryan Khan, Arbaz Seth Merchant and Munmun Dhamecha, in relation to the drugs seized following an NCB raid at a party on the Cordelia Cruise ship, which was mid-sea and on its way to Goa on October 2 night.

Eight persons including Aryan Khan, Arbaz Seth Merchant, Munmun Dhamecha, Vikrant Chhoker, Ismeet Singh, Nupur Sarika, Gomit Chopra and Mohak Jaswal were arrested on October 3 in connection with the drug seizure on the cruise ship, and were produced before Mumbai’s Esplanade Court on October 4.

They were remanded to NCB custody till October 7, which is when the Mumbai Magistrate court sent them to judicial custody for 14 days.

Court Update | Adv. Amit Desai (for Aryan Khan): He mentioned illegal international drug trafficking and included Aryan Khan’s name in it.

I think NCB would know that illegal trafficking has been mentioned in the NDPS Act and it is a serious matter. Such words should not be used as such, all this has been done only to stop the bail plea. Have you been able to connect Aryan Khan in any way? The court has already heard such cases.

Aryan Khan was linked to illegal trafficking without any recovery, posession.

This is a conspiracy in which all these are being linked in it. Not everyone was arrested from the cruise, people were also arrested from outside.

Aryan Khan wasn’t even on the cruise, nothing was found on him.

Illicit trafficking includes things like cultivating, production, manufacturing, consumption, and interstate import and export of drugs. They have nothing to do with such a thing, yet illicit trafficking has been written.

In illegal trafficking, action can be taken under 27A. This is the only provision under which action can be taken, but on going through the remand application, it is found that there is no mention of illegal trafficking in the Panchnama. 

It can be said that in the investigation it was found. But when Aryan Khan was searched, his mobile phone was confiscated…27A is not mentioned in the remand application. This is because they know that Aryan Khan has nothing to do with it.

Court Update | Adv. Amit Desai (for Aryan Khan): In the reply filed by NCB this morning, information about this matter has been given earlier. Later it is said that all these accused are related to each other. 

NCB is making this whole debate on only one thing, that all are connected to each other. Foreign wires are being connected and international drugs are being talked about. 

Now NCB can say peddling, supplying and other things, but on this the court knows that this is said time and again whenever such cases come up.

Whatever things came out later, information was received from the others accused, and the drugs that were found, they got from others. 

We have nothing to do with them, but still have been linked to international drug trafficking and it is being said that this is a conspiracy.

Court Update | Adv. Amit Desai (for Aryan Khan): I am thankful to NCB that in many places they have done cut and paste work. But the names of the rest of the accused were not mentioned in the first remand application. In the end the NCB has written that five people have been arrested. This is the only thread that is connected to Aryan.

Court Update | Adv. Amit Desai (for Aryan Khan): Arbaaz admitted that he was going to use the charas himself, so where does the talk of sale come from in this case?

The recovery of drugs by NCB that took place does not have any connection with Aryan Khan.

Thus, while NCB is repeatedly talking about the big picture, they do not have the right to catch such people who have nothing to do with it.

Court Update | Adv. Amit Desai (for Aryan Khan): Over and over again the drugs and cash are being talked about, but nothing was found on Aryan Khan. And out of all the drugs, only six grams of charas has been found from Arbaaz.

One thing which is made clear again and again is that neither charas, nor MD or any pills or cash was with Aryan.

Aryan didn’t have cash so he couldn’t buy drugs, and since he didn’t buy drugs, he wasn’t going to consume any.

But when they went to the court, then the three accused (Aryan Khan, Arbaaz Merchant, Munmun Dhamecha) were lumped together and Aryan has also been added into the matter of sale, purchase and consumption.

Court Update | Adv. Amit Desai (for Aryan Khan): On the basis of the information, NCB came to know that some people are involved in the sale and consumption of drugs. But on the basis of the information, you can also see that nothing was found with Aryan Khan. 

The information on the basis of which this action was taken proved to be wrong in the case of Aryan Khan. Aryan Khan neither had possession, nor did he use, consume, nor sell it.

The NCB says that Aryan Khan admitted that he was going to consume the charas present with Arbaaz, but the court also knows how to get things admitted.

Court Update | Adv. Amit Desai (for Aryan Khan): After that two more people reach the Departure Gate, who are Aryan Khan and Arbaaz Merchant. 

He was informed of the situation by the NCB officials and asked if they had any drugs. Arbaaz Merchant admitted that charas was in his shoes. Arbaaz Merchant admitted that he consumes charas with Aryan Khan, and Aryan Khan also admitted that he consumes it. Six grams of charas were seized.

Six grams of charas was found from Arbaaz Merchant, but the names of both Arbaaz and Aryan were added for the seizure. They did not get anything from Aryan Khan, which has also been documented.

Court Update | Adv. Amit Desai (for Aryan Khan): This whole affair started at noon on October 2 when my client was called on a cruise ship. Prateek Gaba had called, who is neither an organizer nor has he been arrested.

He reached there at Gaba’s behest. But even before checking in, the NCB took him into custody.

In the Panchnama, the NCB has said that IO Ashish Prasad has said that he had received information that drugs were being brought in the ship for use and sale.

After that, information was given about the names of some people and it was told that they have drugs.

After that, the NCB team started checking at the gate of the ship.

The search started at 6:50 pm. Drugs and contraband were found from some people. Five grams of MD, 10 grams of cocaine and 10 grams of charas were recovered from some people. 

15 tablets of drugs and Rs 40,000 cash were found on Ishmeet Singh Chadda, who said that he was going to use this cash to buy drugs

Court Update |  Lawyer for Accused No 4 Mohak: The reply has not been filed in the case of my client. 

NCB lawyer Advait Sethna: on the behest of the court, we are filing a reply on the first three accused.

Advait Sethna: First let us file the reply and after that the court can decide what should be done for the rest of the accused. I need time till 22nd to file reply of other people.

Lawyer for Accused No 4: This is injustice to us. The maximum punishment in this case is 1 year. NCB is doing this intentionally.

Mumbai Drugs-On-Cruise Case: Aryan Khan, Others Inextricably Connected: Narcotics Control Bureau’s No Bail Argument
Aryan Khan and all other accused in the drugs-on-cruise case are connected and their roles cannot be separated, the Narcotics Control Bureau (NCB) says in its reply to a court that will decide on the bail request of Shah Rukh Khan’s son.

“The ingredients of conspiracy are clear and evident,” says its reply to the court, adding that “one of the applicants cannot be considered in isolation”.

No drugs were found on Aryan Khan when the anti-drugs agency’s officers raided a Mumbai cruise ship party in disguise on October 3. But the NCB says that does not undermine their role.

Court Update |  The NCB reply states:

The material collected during the investigation has primarily revealed that Accused No 1 (Aryan Khan) has role in so far as illicit procurement and distribution of contraband is concerned. 

It is prima facie revealed that Aryan Khan used to procure contraband from Accused No 2 (Arbaaz Merchant). And sources connected to Accused No 2 from whose conscious possession (shoes) 6 grams of charas was recovered. Aryan and Arbaaz have been associated in close collaboration.

Thus, it is so far apparent that Accused No 17 and 19 supplied charas/ganja to Accused No 1 and 2.

The investigations have further revealed that Accused No 3 (Munmun Dhamecha) was arrested with 5 grams of hashish from her conscious possession. She was intercepted with such quantity of contraband from the said Cruise. Thus, as she was arrested with contraband from the said Cruise her culpable mental state is clear and evident.

Court Update | Satish Maneshinde (for Aryan Khan): We have received copies of the reply but someone is yet to arrive for them.

Adv. Amit Desai (for Aryan Khan): Somebody comes then we can start.

Court Update | While replies have been submitted, the hearing has not started yet. Additional Solicitor General Anil Singh and Special Public Prosecutor Advait Sethna, representing the Narcotics Control Bureau, have not reached the court yet.

Court Update | Narcotics Control Bureau lawyers have submitted their reply to the counsel of the accused. In their reply, the NCB says that all the accused in this case are connected so its not possible to dissect their roles from each other.

Court Update | The Narcotics Control Bureau’s counsel has said that they will file a reply in a while. 

Additional Solicitor General (ASG) Anil Singh will also appear on behalf of the NCB in the hearing but he is currently occupied with a hearing at the High Court. Special Public Prosecutors AM Chimalker and Advait Sethna are appearing for the NCB as well.

BJP leader Mohit Bharatiya bites back at NCP leader and spokesperson Nawab Malik in a tweet, after Mr Malik pointed fingers at Mr Bharatiya on Saturday in relation to the Mumbai drugs-on-cruise case. 

Mr Malik had claimed that the Narcotics Control Bureau had initially detained 11 people total from the Goa-bound cruise ship off Mumbai coast last week, but then let off three of them, including the brother-in-law of BJP leader Mohit Bharatiya, a couple of hours later.

Court Update | Counsel Amit Desai is also present along with Satish Maneshinde’s team for Aryan Khan, as is Shah Rukh Khan’s manager Pooja Dadlani.

The court is currently awaiting the Narcotics Control Bureau’s written reply.

After being denied bail twice since his arrest over a week ago in the drugs-on-cruise case, Aryan Khan’s third bail plea did not get heard on Monday, as the Narcotics Control Bureau (NCB) insisted they were not ready with their statement for the Mumbai sessions court. Aryan Khan’s bail request will be heard today after the NCB files its reply to the court.
